Remote Internal Investigations
For years we have worked closely with our clients to ensure that our investigations are approached in a proportionate and considered manner, taking into account all relevant considerations including the ethics, efficiency, and the costs associated with business travel, in addition to the time involved in coordinating physical meetings. Our approach has often encouraged companies to instruct us to conduct their investigations remotely. With the impact of COVID-19 many other businesses now recognise that conducting investigations remotely is, rightly, the new default.
Our forward-thinking and adaptable approach means that we are well-prepared to deal with the current circumstances, and the quickly developing market trends. We already have close working relationships with market leading legal technologists, enabling us to harness the most secure and accurate technology to facilitate our investigations.
For several years we have been deploying technology to assist with all elements of an investigation. From the remote collection of data, the use of Technology Assisted Review (“TAR”) and predictive coding, virtual interview bundles, and secure file-sharing, in addition to conducting remote interviews.
From the very onset of the COVID-19 lockdown, we have been in a position to move seamlessly to provide clients with continuity in relation to their ongoing investigations, and to launch new investigations. We work closely with our clients’ IT teams, and we choose our own technology partners carefully, in order to ensure that the right technology is deployed, at the right time.
Whilst many of the steps involved in remote investigations are easily taken, they cannot be taken without careful risk assessment and planning. As data crosses borders, and is recorded in different jurisdictions, at different times, in different ways, companies need to ensure that they stay on the right side of the law in every country involved, and that they preserve legal professional privilege. We have deep experience in working closely with our clients to provide bespoke, pragmatic, and sophisticated advice – avoiding the legal and strategic pitfalls that exist.
Fulcrum have produced a Practice Note on remote internal investigations alongside expert legal technologists, TransPerfect Legal Solutions, in order to assist all those who have investigations responsibility.
